Lume certifies that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement, and Liability. If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Lume will respond to your request promptly, and within 30 days. Lume has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles to an independent dispute resolution mechanism, the Council of Better Business Bureaus. Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.

What data do we collect?

Lume collects three types of data:

  1. Data that is required by us to provide services to you that you request
  2. Data that is automatically collected by us
  3. Data you voluntarily provide to us with informed consent

We collect the following personal information from you:

  • Contact Information
    Information you are required to provide to us to enable us to contact you. Examples may include name, email address, mailing address, telephone number etc. Contact information may identify you personally.
  • Billing Information
    Information you are required to provide to us to enable us to be paid for the services we provide, or for a third party to provide services through us to you. Examples may include credit card number, bank information, billing address, billing contact name, telephone numbers, email address etc. Billing information may identify you personally.
  • Password Information
    Information that allows you to access the services we provide, technical support, ticketing system and any third party services provided through us. Examples may include user id, account number, access and permission levels, password etc. Password information does not identify you personally, but it may when associated with other information.
  • Technical Information
    Information that allows us to configure the services we provide so that they are more easily provided to you. Examples may include your IP address, browser type, referring/exit pages, operating system, affiliate id etc. Technical information does not identify you personally, but it may when associated with other information.
  • Voluntary Information
    Information you choose to provide to us and that is not necessary for the operation of the services we provide. Examples may include submissions to our knowledgebase, your endorsements of us, your connections to us in social networks etc. It is your decision whether you include information that identifies you personally when you provide voluntary information to us.

Legal Basis for Personal Data Retention

Lume collects and stores personal data for the following legal purposes: 1) with informed consent, 2) for the purpose of providing contractual services requested by individuals, and 3) to carry out contractual obligations as a data processor for clients who are data controllers.

How do we use the data we collect?

We will use contact information as follows:

  • To provide services to you
  • To notify members of any affiliate program that you have contacted us, or purchased services from us, and pay them for this
  • To market and contact you about services
  • To contact you about our business and new products and services we offer
  • To allow third parties to provide their services through us to you

Who Has Access to the Data

Lume does not sell, rent or lease personal customer information to third parties. Data is accessible to approved individuals only, on a need to know basis. These individuals are trained and held accountable for observing our Information Security Policies and Procedures, and maintaining the confidentiality and privacy of personal data.

IP Addresses
We may use your unique network address (IP address) to help diagnose problems with our server(s), administer or improve our website(s).

We may use cookies to keep track of your interaction and time spent on this site or related websites. We may also use them to recognize return visitors and to track our promotions. Lume may collect personally identifiable information from visitors in the way of online forms but only where visitors volunteer such information. Lume may also collect information about how visitors interact with our website. This information may be obtained through the analysis of server logs and through the use of “cookies” placed on user machines. A cookie is a piece of software that a web server can store on a computer system to identify the visitor if they visit the website again. All of the information that we collect through the use of cookies from visitors is not personally identifiable. However, it may be associated with personally identifiable information that visitors provide us through our website(s). We gather this information for internal use only and will never authorize the release of this information with anyone outside of Lume.

Privacy Rights
Customers have the rights to: 1) access their data, 2) rectify, correct or amend their data, 3) erasure of personal data, 4) portability of data, 5) withdraw consent previously given regarding personal data, 6) lodge a complaint. You can update, correct or delete their personal information, or submit a request to exercise any of these rights at any time by contacting Lume at privacy@lumecloud.com.  Exception(s) to access may arise when the burden or expense of providing access would be disproportionate to the risks to the privacy of the individual in the case in question or where the rights of persons other than the individual would be violated, or where another legal purpose requires use of the data. If the data is controlled by a client of Lume, please contact them regarding your data. Lume will respond to all inquiries, in writing, within 30 business days.

Choice and Opt-Out
You may opt out of receiving information about our business, new products, and the services we offer. Simply select the ‘Unsubscribe’ option in the email you receive or send us an email at info@lumecloud.com

Existing customers cannot opt out of receiving information that we deem important for us to communicate in order to provide ongoing services and support (i.e., change in services, scheduled maintenance windows, planned downtime, infrastructure upgrades etc.).

Personal Data of Minors
Lume does not accept, store, or control personal data of individuals under the age of 18, without prior written consent of a legal parent or guardian.

Transfers and Third Parties
You may receive services (partial or in full) from third parties through us to you. Lume will take appropriate measures to protect your privacy and the personal information we transfer to provide an adequate level of privacy protection.

We share your personal data with your consent or as necessary to complete any transaction or provide any product you have requested or authorized. We may also share data with Lume-controlled affiliates and subsidiaries; and with vendors working on our behalf.

In cases of onward transfer to third parties of data of EU individuals received pursuant to the EU-US Privacy Shield, Lume remains responsible and potentially liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Lume proves that it is not responsible for the event giving rise to the damage.

We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Otherwise, Lume cannot be held responsible for any misuse of personal information from any third party. We reserve the right to transfer information collected from our customers in connection with any future transaction involving the transfer of the assets of our company.

Lume uses a self-assessment approach to assure compliance with this privacy policy and periodically verifies that the policy is accurate, comprehensive, prominently displayed, completely implemented and accessible. We also provide an independent way to resolve complaints about our privacy practices.  Lume is responsible and potentially liable in cases of onward transfer of personal data and Lume is subject to the investigatory and enforcement powers of the United States Federal Trade Commission.

Data Retention
All personal data that you provide to Lume, or that is legally collected by Lume is retained so long as you are a client or perspective client of Lume.

Automated Decision Making and Screening
Lume does not use personal data for automated decision making or screening purposes.

Data Security and Integrity
Lume makes every effort to follow industry standard security measures to prevent the loss, misuse, and alteration of the information under our control. However, no information transmitted on the internet or stored on servers is 100% secure. Fraudulent people exist, software and hardware can malfunction and people make mistakes. As a result, we cannot guarantee that any information covered by this policy will be absolutely secure.

Lume will only process personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by the individual.
